Terms of use

1. Who you are dealing with

SpeakSignal is operated by ACE Media Solutions LLC, a limited liability company organised in the State of Utah, United States. "We", "us" and "our" mean that company. "You" means the person using SpeakSignal.

You can reach us at hello@acceleratewebsites.com. We answer within 30 days, and sooner where we can.

2. What SpeakSignal is

SpeakSignal teaches spoken and written English to people who already have a reason to use it — at a counter, in an interview, in a standup, in a meeting. We publish lessons on social channels, and we provide a learning app with lessons, practice activities and a record of your progress.

We are a learning service. We are not a recruiter, an employer, an immigration adviser or an examination board, and nothing here is advice of any of those kinds.

3. Who may use it

The SpeakSignal app is for people aged 13 and over. When you create an account you tell us the year you were born, and we hold you to it. If you are under 18 we treat you as a minor: we collect no product analytics about you at all, and some features may be unavailable.

Indian law requires a parent or guardian's verifiable consent before a child's personal data is processed. We do not yet have a way to verify that consent, and we say so plainly in the privacy notice rather than pretend otherwise. Until we do, a learner under 18 uses SpeakSignal on the understanding that their parent or guardian agrees to it.

The enquiry form on this website is separate and is for adults aged 18 and over only. It has no under-18 path.

4. Your account

Keep your password to yourself, and tell us at the address above if you think someone else has it. An account is for one person. What you do while signed in is treated as done by you.

Give us an email address that reaches you. If we cannot reach you, we cannot tell you about a change to your subscription or to these terms.

5. What it costs

Today the free tier is everything: no lesson, activity or feature is behind a payment. We say this here because it is true now, not because it is a promise about later.

If and when a paid subscription is offered, the price you see is the price the store shows you, in your own currency, at the moment you buy. We never quote a price separately from the store that will charge it.

Payment is taken by the store, not by us. On Android that is Google Play. On the web it is a card payment handled by our payments provider. We receive confirmation that a payment succeeded; we never see or hold your card details.

A subscription renews automatically for the same period until it is cancelled, and the store charges you at the start of each period.

6. Cancelling, and getting money back

You cancel where you bought. A subscription bought through Google Play is cancelled in your Play account's subscription settings; a subscription bought on the web is cancelled from the account page or by writing to us. Cancelling stops the next charge; it does not shorten the period you have already paid for, and you keep access until that period ends.

Refunds follow the policy of whoever took the payment. For a Google Play purchase that is Google's refund policy, and we cannot reverse the charge ourselves however much we might want to. Write to us anyway if something has gone wrong — we will tell you honestly what we can and cannot do, and we will ask the store on your behalf where that is possible.

Nothing in this section takes away a refund right you have under the consumer law that applies to you.

7. What you may do with the lessons

The lessons, exercises, audio, text and design are ours, or are used by us with permission. While your account is in good standing you have a personal, non-exclusive, non-transferable licence to use them to learn.

Please do not republish, resell, or distribute the lessons, use them to train a machine-learning model, scrape the service, share one account between several people, or try to work around the parts of the app that decide what you are entitled to.

8. What you write stays yours

The answers you type remain yours. We use them to mark your work, to move your progress, and to work out what to show you next — that is the whole of it, and the privacy notice says so in more detail.

We do not publish your answers, quote you, or use anything you wrote in marketing unless you have specifically agreed to it.

9. Your privacy

What we collect, why, how long we keep it, and how to have it deleted is set out in the privacy notice, which forms part of these terms. Where the two ever disagree about personal data, the privacy notice wins.

10. The service will change, and will sometimes be down

We add lessons, retire lessons, and change how the app works. We may change or withdraw a feature. Where a change materially reduces something you have paid for, we will tell you and you may cancel.

We provide the service as it is and as it is available. We do not promise that it will be uninterrupted, or free of faults, or that it will work on every device.

11. What we do not promise

We never promise you a job. Not in these terms, not in a lesson, not in an advertisement, not in any wording anywhere. We teach the sentence, and we show you what changed.

We do not promise a particular score, a particular level, a pass in any examination, a visa, a promotion, or any other outcome. How much your English improves depends on you.

12. Limits on what we owe you

To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, lost opportunities, or lost data, arising out of your use of SpeakSignal.

To the extent the law allows, our total liability to you for any claim connected with SpeakSignal is limited to the amount you paid us in the twelve months before the claim arose.

Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded — including for fraud, and including rights you have as a consumer under the law of the country you live in. Those rights stand whatever the rest of this section says.

13. Ending it

You can stop using SpeakSignal at any time, and you can ask us to delete your account and the personal data in it — see the privacy notice.

We may suspend or close an account that is being used to break section 7, to harm another person, or to defraud us or a store. Where we reasonably can, we will tell you why first and give you a chance to put it right.

14. Changes to these terms

When these terms change we publish the new version on this page with a new version number and date. If a change materially affects you, we will tell you before it takes effect. Continuing to use SpeakSignal after that date means the new version applies.

The version and date at the top of this page are always the ones in force.

15. Which law applies

These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules, and the courts of that State are where a dispute would be heard.

This does not take away the protection of the mandatory consumer law of the country you live in, or your right to bring a claim before the courts or consumer forums of that country where the law gives you that right. If you are in India, your rights under Indian consumer law are unaffected.

If any part of these terms turns out to be unenforceable, the rest of them still stand.
